Full Gratuity Formula: First 5 years = 15 days salary per year. After 5 years = 30 days salary per year (1 month per year). EOS is based on Basic Salary only.
Frequently Asked Questions
Is EOS calculated on basic salary or total salary?+
EOS gratuity under Saudi Labour Law Article 84 is calculated on the basic salary only. Housing allowances, transport allowances, and other benefits are not included in the EOS calculation base.
What if I resigned after 3 years?+
If you resign between 2 and 5 years of service, you are entitled to 1/3 of the full gratuity. The full gratuity for 3 years would be 3 × 15 days salary = 45 days. At 1/3, you would receive 15 days salary total.
Do expats get EOS gratuity?+
Yes. Saudi Labour Law applies to all employees in Saudi Arabia, both Saudi nationals and expatriates. Expats are entitled to EOS gratuity under the same Article 84 formula, regardless of nationality.
When must the employer pay EOS?+
The employer must pay EOS gratuity within one week of the last working day. If the employer delays, the employee can file a complaint with the Ministry of Human Resources (MOHRE). Legal interest may apply for late payments.
